What you agree to when you use fency.club, whether you run a club on it or join one through it.
Who we are
Fency is run by Bothy Systems Ltd, a company registered in England and Wales, number 17495204. “We” and “us” mean Bothy Systems Ltd. You can reach us at hello@fency.club.
What Fency is
Fency gives a fencing club a website, a list of its members, memberships and courses people can pay for, and news it can email. A club’s site is at its own address, such as riverside.fency.club or the club’s own domain.
Your account
- You sign in with a code we email you. Keep your email account safe: whoever can read it can sign in.
- Give us true details, and tell us if they change.
- You must be 18 or over to hold an account. A parent or guardian joins and pays for a child.
If you run a club
- You must have the club’s say-so to set it up and run it here.
- What the club publishes, on its site and in its emails, is the club’s. It must be lawful, and the club must have the right to use it, including photographs of people.
- The club decides what it sells, at what price, and its own rules on refunds. It is the seller. We are not.
- The club is responsible for its members’ details. We hold them for the club and only do with them what the club and these terms ask (see Privacy).
- The club only emails news to people who asked for it. Every such email has a way to stop.
- The club’s tax, insurance, safeguarding and duties to its governing body remain the club’s.
If you join or pay a club
- Your membership, course place or guest pass is an agreement between you and the club. The club provides it, and the club answers for it.
- Questions about what you bought, and requests for a refund, go to the club first (see Refunds).
Payments
- Card payments are taken by Stripe, into the club’s own Stripe account. We never hold a club’s money, and we never see your card number.
- A club that takes cards agrees to Stripe’s own terms when it connects its account.
- Fency is free to use. On each card payment to a club we take 0.5%, and Stripe takes its own fee from the club. Payments by bank transfer, standing order, cash or cheque are between you and the club, and we take nothing.
- A membership paid by card may renew by itself. The page says so before you pay, and you can stop it at any time from “Your memberships”.
What you mustn’t do
- Break the law, or help anyone else to.
- Publish anything hateful, harassing, sexual or misleading, or anything that isn’t yours to publish.
- Send email people didn’t ask for.
- Try to get at another club’s or another person’s details, or interfere with the service.
We may take down content, or close a club or an account, that breaks these terms. We’ll say why.
The service
We take reasonable care to keep Fency running and your data safe and backed up. We don’t promise it will never be unavailable or free of faults, and we may change or withdraw features. If we ever plan to close Fency, we’ll give clubs at least 90 days’ notice and a copy of their data.
Leaving
A club can download its members as a spreadsheet at any time, and can leave when it likes. Ask us and we’ll delete a club or an account, apart from records the law makes us or the club keep.
Our liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn’t let us limit. Beyond that, we are not liable for a club’s acts or omissions, for losses we couldn’t reasonably have foreseen, or for loss of profit or business. Our total liability to you in any year is limited to the greater of £100 and the fees we received from your club’s payments in that year. If you are a consumer, your statutory rights are not affected.
Changes
We may change these terms. We’ll put the date at the top, and email clubs’ admins before a change that matters takes effect.
Law
These terms are governed by the law of England and Wales, and its courts decide any dispute.
